Use of the ShootingMind Mobile Application

Welcome to ShootingMind.
These Terms of Use (the "Terms", "Terms & Conditions") govern the use of the ShootingMind mobile application, the website https://www.shootingmind.com, and related services (collectively, the "Service").
By using the Service or creating an account, you confirm that you have read these Terms, understand them, and agree to comply with them.
If you do not agree with any provision of these Terms, you must not use the Service.
Definitions
In these Terms, the terms below have the following meanings, unless the context clearly indicates otherwise.
ShootingMind — the mobile application, the website https://www.shootingmind.com, related software services, software, features, and other digital services provided by the Operator.
Operator — the sole proprietor Oleksandr Sukach, who is the owner and administrator of the Service.
Service — the totality of the software, website, mobile application, server infrastructure, databases, APIs, algorithms, and other technical means that ensure the operation of ShootingMind.
User — any natural person who uses the Service, regardless of whether they have a registered account.
Account — the user's personal profile created in the Service to obtain access to its features.
Personal Data — any information relating directly or indirectly to an identified or identifiable natural person.
User Content (User Generated Content, UGC) — any data, materials, or information that the user creates, uploads, publishes, transmits, or otherwise places in the Service, including text entries, training results, photographs, video recordings, comments, messages, notes, and other materials.
Training Data — information related to the user's training activity, including exercise results, statistics, metrics, equipment used, settings, notes, training history, timestamps, training location, and other data relating to sporting activity.
Athlete — a user who uses the Service to manage their own training activity and record results.
Coach — a user to whom an athlete has voluntarily granted access to specified training data through the functionality of the Service.
Sports Club — a legal entity or organization to which the user has granted access to their data in accordance with the functionality of the Service.
Sports Federation (Federation) — a sports organization to which the user has voluntarily granted access to their data through the functionality of the Service.
Shooting Range — an indoor shooting range, shooting complex, training ground, or other facility, information about which may be displayed in the Service.
Voice Input — a feature of the Service that allows the user to enter information by recording their voice, followed by automatic transcription using third-party speech recognition technologies.
Artificial Intelligence (AI) Features — software features that use artificial intelligence, machine learning, or automated data analysis technologies to generate recommendations, assessments, statistics, forecasts, or other information.
De-identified Data — information from which personal identifiers have been removed or altered in such a way that it does not allow a specific user to be identified without the use of additional information.
Aggregated Data — statistical information formed by combining the data of many users, which does not allow an individual person to be identified.
Privacy Policy — the document that defines the procedure for collecting, using, storing, transferring, and protecting users' personal data during use of the Service.
Third Parties — any natural or legal persons who are not the user or the Operator, including providers of technical services, partners, personal data processors, and other counterparties.

In these Terms, the terms "you", "your", and "User" mean the person using the Service. The terms "we", "us", "our", "ShootingMind", and "Operator" mean the sole proprietor Oleksandr Sukach, unless the context clearly indicates otherwise.
2. Subject Matter of the Service
ShootingMind is a digital service for athletes, coaches, sports clubs, and other persons engaged in sport or training shooting.
The Service may provide the ability to:
- keep an electronic training log;
- store exercise results;
- analyze your own progress;
- view statistics;
- work with training plans;
- find information about shooting ranges;
- interact with coaches;
- interact with sports clubs;
- interact with sports federations;
- use voice input features;
- use other features that may be added in the future.
ShootingMind is exclusively informational software.
The Service does not sell weapons, ammunition, or other goods regulated by law, does not organize shooting events, does not provide firearms handling training, and does not provide safety instruction.
3. Who May Use the Service
The Service may be used by persons who have reached the age of 14 or another minimum age of digital consent established by the legislation of their country of residence.
Persons aged 14 to 18 may use the Service only with the permission of their parents, legal representatives, or guardians.
During registration, the user confirms that:
- they are at least 14 years old;
- if they are a minor, they have obtained the necessary permission from their legal representatives.
We may require additional confirmation of age or of the consent of legal representatives in cases provided for by law.
For users located in the territory of European Union member states, the GDPR requirements regarding the age of digital consent apply. If the legislation of the user's country of residence establishes a higher minimum age than that specified in these Terms, the requirements of such legislation apply.
4. Account Registration
To use certain features of the Service, it is necessary to create an account.
During registration, the user undertakes to provide accurate information.
The user is responsible for:
- maintaining the confidentiality of their account credentials;
- all actions performed through their account;
- promptly notifying ShootingMind of any unauthorized use of the account.
We have the right to suspend or terminate access to an account in cases of violation of these Terms.
5. Safe Use of Weapons and the Limits of the Service's Responsibility
This section is an essential condition of use of the Service.
ShootingMind is created exclusively as a digital sports training log and a tool for analyzing sporting results.
The Service:
- does not teach firearms handling;
- does not replace an instructor or coach;
- is not a methodological manual;
- is not an official safety instruction;
- does not confirm the correctness of exercise performance;
- does not verify the compliance of your actions with legal requirements.
Any recommendations, statistics, automatic analysis, advice, or future features using artificial intelligence are of an exclusively informational nature.
They:
- may be incomplete;
- may contain inaccuracies;
- may be erroneous;
- must not be used as the sole basis for making any decisions.
Any decisions regarding the use of weapons, participation in training, performance of exercises, compliance with safety rules, the requirements of sports federations, or legislation are made by the user independently and at their own risk.
The user is solely responsible for:
- the legality of possessing and using weapons;
- obtaining the necessary permits;
- undergoing safety briefings;
- complying with safety rules;
- complying with the requirements of sports clubs and shooting ranges;
- complying with the legal requirements of the country where they are located.
ShootingMind is not liable for any bodily injury, property damage, or administrative or criminal liability that may arise as a result of the use of weapons or the user's violation of legal requirements or safety rules.
6. Information About Shooting Ranges
The Service may contain information about shooting ranges, sports clubs, training grounds, federations, coaches, and other organizations.
Such information is provided exclusively for reference and informational purposes.
We do not guarantee that information about:
- the address;
- operating hours;
- contact details;
- the cost of services;
- availability;
- the list of exercises;
- visiting rules;
- equipment requirements;
- requirements regarding documents or permits;
- other details
is complete, current, or accurate.
Before visiting any shooting range, the user must independently verify the currency of the information directly with the relevant facility.
The placement of information about a shooting range, club, coach, or other organization does not mean that ShootingMind recommends, endorses, or confirms the quality of their services.
We are not responsible for the activities of third parties represented in the Service.
7. Free Use and Future Paid Features
As of the effective date of these Terms of Use, the core features of ShootingMind are provided free of charge.
In the future, we may introduce:
- paid features;
- subscriptions;
- premium access;
- separate digital services;
- professional tools;
- other commercial offerings.
Users will be notified in advance of the introduction of paid features.
No feature that was free at the time the user began using it will become paid for materials already created by the user without prior notice.
The terms of payment, refunds, automatic subscription renewal, and other financial terms will be defined by separate rules, which will become an integral part of these Terms upon their publication.
8. Voice Input
ShootingMind may provide the ability to enter information by voice.
To provide this feature, audio recordings may be transferred to third-party providers of machine speech recognition and automatic transcription technologies.
Such providers act as data processors and are used exclusively for the technical provision of the voice input feature.
The list of specific providers may change without amendments to these Terms.
The user agrees that, in order to use voice input, the relevant audio data may be transferred to such providers in accordance with the Privacy Policy.
The user is not obliged to use the voice input feature.
9. User Content (User Generated Content)
ShootingMind may allow users to create, upload, publish, or share their own content, including but not limited to:
- training results;
- photographs;
- videos;
- comments;
- messages;
- notes;
- reviews;
- other content.
The user retains ownership of the content they create.
At the same time, the user grants ShootingMind a non-exclusive, royalty-free, worldwide license to use such content exclusively for the purposes of:
- ensuring the operation of the Service;
- storage;
- backup;
- display;
- transmission to other users in accordance with privacy settings;
- moderation;
- improving the functioning of the Service.
Such license remains in effect until the relevant content is deleted by the user or their account is deleted, unless otherwise required by law.
10. Prohibited Content
The user is prohibited from posting or distributing through the Service any content that:
- violates the law;
- violates the rights of third parties;
- contains defamation or insults;
- contains calls to violence;
- contains discriminatory statements;
- promotes terrorism or extremism;
- contains child sexual exploitation;
- infringes intellectual property rights;
- contains spam;
- contains malicious software;
- is used for fraud;
- contains the personal data of other persons without their consent;
- is used for the illegal trade in weapons, ammunition, or other items whose circulation is restricted by law.
It is also prohibited to:
- impersonate another person;
- use bots to create false statistics;
- manipulate ratings;
- interfere with the operation of the Service;
- gain unauthorized access to the accounts of other users.
11. Moderation
ShootingMind has the right, without prior notice, to:
- review published content;
- hide content;
- delete content;
- restrict certain features;
- temporarily block accounts;
- permanently terminate access to the Service.
Such decisions are made if we reasonably believe that a user is violating these Terms, the law, or the rights of other persons.
We are not obliged to carry out a preliminary review of all content published by users.
12. Access for Coaches, Sports Clubs, and Federations
ShootingMind may provide users with the ability to share information about their training, results, and other data with coaches, sports clubs, federations, or other organizations.
Such access is granted exclusively with the user's voluntary consent (opt-in).
The user independently determines:
- to whom to grant access;
- exactly which data to make available;
- the duration of such access, if the relevant feature is supported.
The user has the right to revoke the granted access at any time, unless otherwise provided by law or a separate agreement.
After access is revoked, new data is no longer provided to the relevant persons; however, information that they lawfully received before the moment of revocation may remain with them in accordance with applicable law.
For users who have not reached the age of majority, certain sharing features may require additional confirmation from a legal representative.
13. Use of Statistical Data
The user agrees that ShootingMind has the right to use information obtained during the use of the Service in de-identified and aggregated form.
Such data may be used for:
- statistical analysis;
- scientific research;
- the development of sports analytics;
- improving algorithms;
- training machine learning models;
- creating rankings;
- creating averages;
- publishing generalized statistical materials;
- creating benchmarks;
- marketing materials.
In the course of such use, users' personal data is not disclosed, nor is information that allows a specific person to be identified directly or indirectly.
14. Commercial Use
ShootingMind is intended for personal use by athletes.
Use of the Service by legal entities, sports schools, clubs, federations, shooting ranges, coaches, or other organizations for commercial purposes may only take place on the basis of a separate written agreement with ShootingMind.
Without such an agreement, it is prohibited, in particular, to:
- integrate the Service into your own commercial products;
- use the Service as part of paid coaching programs;
- carry out mass administration of athletes;
- use the API or automated means of collecting information;
- resell access to the Service;
- use the Service's data for the commercial activities of third parties.
This restriction does not apply to ordinary personal use of the Service by athletes.
15. Intellectual Property
All intellectual property rights in the Service, including but not limited to:
- program code;
- design;
- interface;
- logos;
- names;
- texts;
- graphics;
- algorithms;
- databases;
- software,
belong to ShootingMind or the respective rights holders.
The use of any intellectual property objects without the prior written consent of the rights holder is prohibited, unless expressly provided otherwise by law.
16. Prohibited Actions
The user has no right to:
- decompile or disassemble the software;
- carry out reverse engineering;
- circumvent technical restrictions;
- gain unauthorized access to servers;
- use automated scripts or bots;
- create excessive load on the infrastructure;
- use the Service for illegal activities;
- distribute viruses or other malicious code;
- interfere with the activities of other users;
- use the Service in a manner that may harm its operation or reputation.
17. Termination of Access
We may temporarily restrict or completely terminate a user's access to the Service in the event of:
- violation of these Terms;
- violation of the law;
- use of the Service for fraud;
- violation of the rights of other persons;
- creating threats to the security of the Service;
- other material violations.
If possible, we will inform the user of the reason for such a decision.
18. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis.
To the extent permitted by law, ShootingMind does not guarantee that:
- the Service will operate without interruption;
- the Service will be available at any given time;
- the operation of the Service will be entirely error-free;
- all errors will be corrected;
- the information contained in the Service will always be complete, current, or accurate;
- the results of using the Service will meet the user's expectations.
We may temporarily restrict the operation of certain features or the entire Service in connection with technical maintenance, updates, error correction, legal requirements, or for other justified reasons.
19. Limitation of Liability
To the extent permitted by applicable law, ShootingMind is not liable for:
- any direct or indirect damages;
- lost profits;
- loss of income;
- loss of data;
- loss of sporting results;
- loss of business reputation;
- interruption of activities;
- any other pecuniary or non-pecuniary losses,
arising from the use of, or inability to use, the Service.
ShootingMind is also not liable for:
- the actions of third parties;
- decisions of coaches;
- decisions of sports clubs;
- decisions of federations;
- the activities of shooting ranges;
- the operation of third-party services;
- interruptions in the operation of the Internet;
- errors of operating systems;
- errors of the App Store or Google Play platforms;
- the consequences of using any recommendations or analytics generated by the Service.
Nothing in these Terms limits the liability of ShootingMind in cases where such limitation is expressly prohibited by law.
20. Account Deletion
The user has the right at any time to delete their account using the corresponding feature in the Service or by contacting us using the contact details specified in these Terms.
After the account is deleted, the user's personal data is deleted or anonymized in accordance with the Privacy Policy and legal requirements.
Certain data may be retained for the period necessary for:
- compliance with legal requirements;
- resolution of disputes;
- ensuring information security;
- fulfillment of contractual obligations.
21. Changes to the Terms
We have the right to change these Terms from time to time.
In the event of material changes, we will notify users by means of:
- a notification in the Service;
- an e-mail;
- or another available method.
The new version of the Terms enters into force from the moment of its publication or from another date specified in the notification.
Continued use of the Service after the changes enter into force constitutes the user's agreement to the new version of the Terms.
If the user does not agree with the changes, they must stop using the Service and delete their account.
22. Governing Law and Dispute Resolution
These Terms are governed by the laws of Ukraine.
Any disputes arising in connection with the use of the Service shall be considered by the courts of Ukraine in accordance with the rules of jurisdiction established by the legislation of Ukraine.
If the user is a consumer and permanently resides in a member state of the European Union, nothing in these Terms deprives them of the rights granted by the mandatory provisions of the legislation of the state of their habitual residence.
23. Severability
If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the other provisions.
The invalid provision shall be replaced by a provision that most closely corresponds to its legal and economic purpose.

25. Use of Artificial Intelligence Features
Certain features of the Service may use artificial intelligence, machine learning, or automated data analysis technologies.
Any recommendations, conclusions, assessments, forecasts, advice, or other results of the operation of such features are of an exclusively informational nature.
They:
- are not professional sports consultation;
- are not a coach's recommendations;
- are not instructions for performing exercises;
- are not recommendations for the safe handling of weapons;
- may be incomplete, inaccurate, or erroneous.
The user independently assesses the appropriateness of using any recommendations generated by the Service.
ShootingMind does not guarantee the correctness or suitability of the results of the operation of artificial intelligence features for the user's specific situation.
26. Force Majeure
ShootingMind is not liable for full or partial non-performance of its obligations if such non-performance is the result of circumstances that we could not reasonably foresee or control.
Such circumstances include, in particular:
- war;
- military operations;
- terrorist acts;
- mass riots;
- a state of emergency;
- natural disasters;
- fires;
- floods;
- earthquakes;
- epidemics or pandemics;
- large-scale cyberattacks;
- power outages;
- data center failures;
- interruptions in the operation of the Internet;
- actions of public authorities;
- other force majeure circumstances.
After such circumstances cease, ShootingMind will make reasonable efforts to restore the operation of the Service as quickly as possible.
27. Assignment of Rights
ShootingMind has the right to transfer, in whole or in part, its rights and obligations under these Terms to any natural or legal person in connection with:
- reorganization;
- sale of the business;
- sale of individual assets;
- attraction of an investor;
- merger;
- acquisition;
- other corporate changes.
In such a case, the users' rights provided for by law remain in effect.
The user has no right to transfer their rights or obligations under these Terms to third parties without the prior written consent of ShootingMind.
28. Compliance with Laws and Sanctions
The user undertakes to use the Service exclusively in accordance with the legislation of the state in which they are located.
The user has no right to use the Service:
- for activities prohibited by law;
- in violation of export control requirements;
- in violation of international sanctions, where applicable;
- for the purpose of circumventing restrictions established by law.
ShootingMind has the right to restrict or terminate access to the Service in cases where this is necessary to comply with legal requirements or mandatory sanctions regimes.
29. Final Provisions
These Terms constitute the entire agreement between the user and ShootingMind regarding the use of the Service and supersede all prior arrangements on this matter.
The Privacy Policy is an integral part of these Terms.
